Terms of Service

Wsec.ai is operated by EverCodex Systems LLC, a Washington limited liability company ("Wsec.ai," "we," "us," "our"). These Terms govern your use of the Service.
1. Acceptance
By using Wsec.ai (the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Wsec.ai provides AI-powered compliance tools, interactive wizards, calculators, code-trained chatbots, and optional human-in-the-loop services (phone consultations and human plan review) to assist with residential energy code compliance.
The Service currently covers:
- Washington — the Washington State Energy Code, Residential (WSEC-R), as adopted in the Washington Administrative Code.
- Oregon — Chapter 11 (Energy Efficiency) of the Oregon Residential Specialty Code (ORSC), as adopted by the Oregon Building Codes Division.
States and code editions may be added, changed, or withdrawn. The states and editions available to you are shown in the Service at the time you use it; this list is descriptive, not a promise of continued availability.
The Service is a software and advisory support tool only. It does not include licensed engineering, architectural, legal, or construction contracting services. See Section 4.
The Service is currently in beta. Features may change, be added, or be removed as we improve the platform. You acknowledge that calculations, AI outputs, and software behavior may be refined over time.
3. Code Editions, Effective Dates, and Phase-In Periods
Energy codes are adopted state by state, take effect on a stated date, and are commonly subject to a phase-in period during which more than one edition is simultaneously in force for different projects.
Which edition applies to your project is determined by your jurisdiction — generally by the date of your permit application — and not by us, and not by which edition you select in the Service. You are responsible for confirming the edition your jurisdiction enforces for your project before relying on any output.
Where the Service supports more than one edition, it will ask you to identify the edition that applies, and every output states the edition it was computed under. An output computed under one edition is not a statement, representation, or warranty about any other edition. If you select an edition that does not apply to your project, the output will not be correct for your project.
We do not represent that the Service supports every edition in force in a covered state at any given time. An edition we do not support is simply unavailable; the absence of an edition is not a representation that it does not apply to you.
4. No Professional Advice — "AS IS"
All outputs (AI-generated or human-assisted) are provided "AS IS" with no warranties of any kind. We do not guarantee acceptance by any Authority Having Jurisdiction (AHJ). Final code compliance is always your responsibility and that of the licensed professionals you retain.
We do not practice professional engineering, architecture, or law, we do not provide stamped or certified professional services, and we do not undertake, offer to undertake, or bid on construction contracting work. Specifically:
- In Washington, we do not practice professional engineering (RCW 18.43) or architecture (RCW 18.08), and we do not offer or perform work as a construction contractor (RCW 18.27).
- In Oregon, we do not practice engineering (ORS 672.002 to 672.325) or architecture (ORS 671.010 to 671.220), and we do not undertake, offer to undertake, or submit a bid to do work as a construction contractor (ORS 701.021). We hold no Oregon Construction Contractors Board license and perform no work requiring one.
- In every state, we do not provide legal advice and no communication from us creates an attorney-client relationship.
Any professional seal, certification, stamped drawing, or licensed contracting service your project requires must come from a separately retained licensed professional or licensed contractor.
Where our personnel describe construction or contracting experience, that description is biographical background about the individual. It is not an offer to perform contracting services and does not represent that we are licensed or registered to contract in any state.
5. Your Content and Our Rights
By submitting content (plans, wizard inputs, chatbot messages, etc.), you grant EverCodex Systems LLC a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, store, analyze, and create derivative works from it for the purpose of operating, improving, and training the Service (including its human review components).
We may de-identify and aggregate your data, and we own that aggregated data outright. We will not sell, license, or distribute your identifiable individual plans, projects, or wizard inputs to third parties. The boundary is identifiability — anything that could be traced back to you or your specific project will not be commercialized to outside parties; anonymized aggregate data may be.
You represent and warrant that you own or have obtained all necessary rights, permissions, licenses, and authorizations to submit your Content and to grant the license described above. You acknowledge that architectural and engineering drawings may be protected by copyright held by the licensed designer or firm that produced them, and that you are responsible for confirming you have authority to upload such content. You agree to indemnify Wsec.ai against any third-party claims arising from your submission of content you did not have the right to submit.
You acknowledge that you have no expectation of privacy in any content submitted to the Service.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose;
- Submit content you do not have the right to submit;
- Attempt to gain unauthorized access to the Service, other user accounts, or our infrastructure;
- Interfere with or disrupt the Service, including via excessive automated requests, scraping, or denial-of-service attempts;
- Reverse engineer, decompile, or otherwise attempt to extract source code from the Service;
- Misrepresent your identity, affiliation, or the information you submit; or
- Use the Service to harass, harm, or impersonate others.
We reserve the right to suspend or terminate access for violation of this Section.
7. Limitation of Liability
To the maximum extent permitted by law, our total liability to you will not exceed the greater of $100 or the fees you paid us in the 12 months before the claim. We are not liable for any indirect, consequential, or punitive damages, including permit delays, redesign costs, or lost profits.
8. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Service, your submission of inaccurate information, or your submission of content you did not have the right to submit.
9. Payment and Refunds
Pricing for each project or service is shown on the Site at the time of purchase.
The price displayed for a project or service is the total price you pay. We do not add mandatory service charges, processing fees, convenience fees, or any other unavoidable fee on top of the displayed price. Any applicable government taxes are stated separately.
Payment is collected by our third-party payment processor at the time of purchase. Wsec.ai does not currently offer recurring subscriptions; if subscription products are added in the future, those terms will be presented and accepted separately at that time. Refund decisions are made at our sole discretion on a case-by-case basis.
10. Modifications to These Terms
We may update these Terms from time to time. The version of these Terms in effect at the time of your purchase governs that transaction. Continued use of the Service after an update constitutes acceptance of the updated Terms for any future purchases.
11. DMCA Designated Agent
A Designated Agent for the Service is registered with the United States Copyright Office under the Digital Millennium Copyright Act. The registration is listed in the USCO DMCA Designated Agent Directory under EverCodex Systems LLC. You may also send DMCA notices complying with 17 U.S.C. § 512(c)(3) to support@wsec.ai. We will respond to valid notices in accordance with the DMCA.
12. Governing Law & Dispute Resolution
These Terms are governed by Washington law. Any dispute will first attempt resolution through mediation in Spokane County, Washington. If mediation fails, the dispute will be resolved exclusively in the state or federal courts located in Spokane County, Washington.
Nothing in these Terms waives, limits, or requires you to give up any right or remedy that the consumer protection law of the state where you reside makes non-waivable. Where such a law applies to you and conflicts with this Section, that law controls to the extent of the conflict.
